British Tennis Membership - Terms & Conditions

British Tennis Membership is the LTA Registered Membership Scheme provided for in LTA Rule 4 (a copy of the LTA Rules is available at www.lta.org.uk/Articles/ About-Us/LTA-Rules/) and these Terms & Conditions apply to your purchase of/application for British Tennis Membership from the Lawn Tennis Association ("LTA") whose address is 100 Priory Lane, Roehampton, London SW1 5 5JO. References to "we", "us" and "our" should be construed as references to LTA.
1 Introduction
By applying for British Tennis Membership you agree to be bound by the following Terms and Conditions. The terms and conditions do not affect your statutory rights as a consumer.
2 British Tennis Membership
2.1 British Tennis Membership was launched on 1 March 2008.
2.2 There are two categories of British Tennis Members:
   2.2.1 British Tennis Member (Affiliated Club Member);
and
   2.2.2 British Tennis Member (Non-Affiliated Member).
Within each category of membership there are three different classes of membership. Currently these are Adult Membership (for those aged 18 and above on the date on which their application is processed), Junior Membership (for those aged between 9 and 17 years on the date on which their application is processed) and Child Membership (for those aged 8 years and below on the date on which their application is processed)
2.3 To become a British Tennis Member in any category, you must apply for the core package of membership benefits ("the Core Package"). In addition to the Core Package you may apply for additional benefits offered in the add-on packages ("Add-on Packages"). The price and duration of the Core Package and any Add-on Packages are subject to change over time, but their duration will ordinarily run for 12 months from the date of purchase.
2.4 British Tennis Member (Affiliated Club Member) - members of LTA affiliated tennis clubs may apply to be a British Tennis Member (Affiliated Club Member). If you are accepted by the LTA as an Affiliated Club member, you will receive the British Tennis Membership Core Package (which includes entry into the member's affiliated club's Wimbledon Ticket Ballot) at no cost until at least 29th February 2012, unless you terminate either your membership of an affiliated club or of British Tennis, or your club terminates its affiliation to the LTA. In each case you must notify the LTA of such termination or inform the LTA of any change in your affiliated club. Once you are a British Tennis Member you may apply for any British Tennis Membership Add-on Packages at any time subject to payment of the full price for such packages.
2.5 British Tennis Member (Non-Affiliated Member) - individuals who are not members of an LTA affiliated club may apply to be a British Tennis Member (Non-Affiliated Member) subject to payment of the full price for the Core Package and any Add-on Packages required and acceptance by the LTA as a British Tennis Member. Subject to receiving payment of your annual membership fee, your British Tennis Membership Core Package will renew automatically. If the LTA does not receive your membership fee within 2 months of the renewal date your membership will cease. You may apply for any Add-on Packages at any time and these will also be renewed subject to receiving payment of the fees in respect of those packages.
2.6 Membership does not entitle you to attend or vote at LTA General Meetings and does not affiliate you to the LTA.
2.7 Membership is non-transferable and your Membership card may only be used by the person to whom it has been issued.
2.8 Persons under 18 years of age at the date of application are only eligible for Junior or Child British Tennis Membership (as appropriate) and must have parental/guardian consent on the application form.
2.9 Any benefits and services that may be made available to you by the LTA, are at the discretion of the LTA and are subject to withdrawal at any time without notice to you. The LTA shall decide which benefits and services fall within the Core Package and Add-on Packages from time to time.
2.10 The LTA reserves the right, at its absolute discretion and without assigning a reason, to refuse any application or renewal. The LTA also reserves the right to suspend or cancel the membership of any person who is found to have been in breach of these conditions or any further regulations and conditions from time to time prescribed by the LTA or in the reasonable opinion of the LTA is guilty of conduct which is detrimental to the reputation of the LTA or is detrimental to the interests of the game of tennis or is otherwise offensive or dishonest in dealings with the LTA.
2.11 If payment is required and you are paying by debit or credit card we must receive full details of your debit/ credit card with your application. On receipt of your application we will debit your debit/credit card for the price or will cash your cheque (as appropriate). However, our acceptance of your application remains subject to our approval. Once we have reached a decision on your application we will either confirm that your application has been accepted by us or notify you that we cannot accept your application. We will contact you by either sending an email to you at the email address you provide in your application form or by sending a letter to the address that you provide in your application form. If we cannot accept your application and we have taken payment, we will confirm that your debit/credit card has been re-credited or shall refund you the price (as appropriate).
2.12 Our acceptance of your application brings into existence a legally binding contract between us.
2.13 As we are a UK organisation, all charges shown in this Leaflet are in Pounds Sterling. If you are purchasing from overseas, your card issuer will convert the charge into your local currency. This Leaflet and our Terms and Conditions have been designed for use within the United Kingdom. Whilst we will consider requests for services from outside the United Kingdom, we give no warranty, expressed or implied, that our Leaflet or the making of any application from outside the UK, complies with any applicable non-UK laws or regulations. Accordingly, any products or promotions not permitted under your local law are not offered to you. Furthermore, we reserve the right to refuse any application at our discretion from overseas customers and we will have no obligation to provide you with any reasons for refusing an order.
3. Wimbledon Ticket Ballots
3.1 All Adult and Junior British Tennis Members on the date of application/purchase, are eligible for entry into a Wimbledon Ticket Ballot Child Members are not eligible for inclusion in any LTA Affiliated Club Wimbledon Ticket Ballot or the British Tennis Wimbledon Ticket Ballot.
3.2 If you are an Adult or Junior British Tennis Member (Affiliated Club Member) you will be entered into your LTA affiliated club's Wimbledon Ticket Ballot. If you are a British Tennis Member (Non-Affiliated Member) you will be entered into the centrally run British Tennis Wimbledon Ticket Ballot. It is not possible to be entered into both an LTA affiliated Club Wimbledon Ticket Ballot and the centrally run British Tennis Wimbledon Ticket Ballot. The ballots will be run in accordance with the applicable terms and conditions for such ballot (Please see the LTA Ticket Ballot Conditions at www.ltaorg.uk). If you do not wish to be entered in the relevant ballot you must notify your club or the LTA (as appropriate).
3.3 Any Wimbledon tickets issued to British Tennis Members through any Wimbledon Ticket Ballot are subject to the terms and conditions imposed by the Committee of Management of The Championships and the LTA.
4. Other Ticket Ballots
The LTA may, from time to time and when tickets for events become available, run ballots for the allocation of tickets which may be subject to additional entry criteria. As a British Tennis Member you may be eligible for inclusion in such ballots subject to the relevant additional entry criteria The ballot will be run in accordance with the LTA Ticket Ballot Conditions.
5. Prices and Delivery Charges
5.1 The prices payable for the British Tennis Membership provided to you are the prices set out in our Leaflet in Pounds Sterling on the date of your application.
5.2 Our prices are inclusive of VAT and postage. Overseas applicants are required to pay an additional sum for postage as detailed in our Leaflet.
5.3 Any overpayment of membership fees may not be reclaimed after six months have elapsed from the date of the overpayment
6.Termination
6.1 No refunds will be made on early termination of membership.
6.2 You agree that on our acceptance of your application you will immediately become a British Tennis member and entitled to all the benefits of membership (relevant to the packages you have applied for) such that the membership service provided to you will begin at that time and before the conclusion of the seven day statutory cancellation period provided for under the Consumer Protection (Distance Selling) Regulations 2000 and that the seven day cancellation period ends on our acceptance of your application.
7. Warranties and Liability
Whilst every effort is made to ensure that the benefits and services provided by third parties (e.g. discounts) will be delivered and be of a suitable standard, the LTA is in no way responsible for such benefits and services, which will remain the sole responsibility of such third parties. The LTA makes no representation, warranty, recommendation or endorsement of the goods and services provided by such third parties and you accept that none is given or implied.
8. Changes to these Terms and Amendments to Content
British Tennis Membership is subject to such further regulations and conditions as may from time to time be prescribed by the LTA and published on our website (at www.ltaorg.uk).

10. Data Protection Act 1998
The LTA confirms that it will process you personal data in accordance with the Data Protection Statement signed by you on the application form and the Data Protection Act 1998.
11. Governing Law & Jurisdiction
These Terms and Conditions shall be governed by, and construed in accordance with, the laws of England and Wales and the parties irrevocably agree that the courts of England and Wales shall have exclusive jurisdiction to settle any disputes that may arise out of, under, or in connection with these terms or the legal relationship established by them, and for those purposes irrevocably submit all disputes to the jurisdiction of the courts of England and Wales.
12. Entire Agreement
These Terms and Conditions, together with your application form, our current prices and contact details, set out the whole of our agreement relating to the supply of membership to you by us. Nothing said by any LTA or Club representative on our behalf should be understood as a variation of these Terms and Conditions or as an authorised representation about the nature or quality of any goods/services offered by us. Except for fraud or fraudulent misrepresentation, we shall have no liability for any such representation being untrue or misleading.
